Bill Cosby's appeal of his sex-crime conviction set for crucial hearing - USA TODAY Posted: 12 Aug 2019 04:26 AM PDT Bill Cosby's appeal of his sex-crime conviction set for crucial hearing - USA TODAY CLOSE CLOSE Bill Cosby's legal team is readying a long-shot bid to get his sexual assault conviction overturned. They're also fighting civil lawsuits filed by some accusers that threaten to drain his vast fortune. (Sept. 27) AP Bill Cosby's effort to erase his conviction for sexual assault goes before a Pennsylvania appellate panel Monday for a hearing expected to focus on whether the trial judge made prejudicial errors or properly allowed testimony about Cosby's "decades-long pattern" of sexual misconduct.  There is a lot riding on this hearing for Cosby: Under Pennsylvania law, the only guaranteed appeal venue for a defendant is with the Pennsylvania Superior Court in the state capital of Harrisburg. The hearing will be before a three-judge panel and it could be short: Typically, each side gets about 15 minutes to make its case – but that counts the questions the judges may ask. Interruptions can be expected, shortening even more the time each side has to argue. The Commonwealth, specifically Montgomery County District Attorney Kevin Steele, will be represented by Robert Falin, chief of the district attorney's appellate unit. The judges will not issue a decision that day, and there is no telling when they will.  If the decision goes against Cosby – meaning the three-count guilty verdict and the three-to-10 year sentence is affirmed – then Cosby stays in his prison cell near Philadelphia and his lawyers can try to persuade the Pennsylvania Supreme Court to hear his appeal. But the high court doesn't have to take the case and there is no guarantee it will. Accuser Andrea Constand returns to the courtroom during a lunch break at the sentencing hearing, Monday, for Bill Cosby.  (Photo: David Maialetti/AP) The stakes also are high for the prosecution side, which includes #MeToo movement and anti-rape activists, who hailed Cosby's conviction as retribution for the five-dozen other women who have accused him of sexual misconduct dating back to the mid-1960s. The Rape, Abuse & Incest National Network (RAINN) filed a friend-of-the-court brief supporting the conviction.  The Cosby case is frequently referred to as the first celebrity trial of the #MeToo era: Although his first trial in June 2017 took place before the movement surged in November 2017, his second trial took place nearly a year later.   But in fact, so far Cosby is the only celebrity convicted post-MeToo: the New York sexual assault case against fallen Hollywood mogul Harvey Weinstein is still pending, as are four sets of sex-crime charges in three states against R&B star R. Kelly. And the Massachusetts groping case against Oscar winner Kevin Spacey collapsed last month.  The Cosby appeal, however, will focus on something more nuts-and-bolts legalistic, one that comes up in scores of non-celebrity criminal cases: Was his trial in Montgomery County, Pennsylvania, conducted properly or were there mistakes that produced an unfair result that should be overturned? He was sentenced in September and has been locked up in a state prison ever since, despite repeated efforts to be released while his case is on appeal.  Cosby says his encounters with Constand and with other accusers were consensual.  His appellate brief features a litany of alleged errors by trial Judge Steven O'Neill, who also presided over his first trial. Perhaps the most important: O'Neill allowed five other accusers to testify about separate and uncharged crimes they say Cosby committed against them in the past, to establish a pattern of "prior bad acts" to bolster Constand's accusations. O'Neill, who allowed only one such accuser to testify at the first trial, also filed a brief with the appellate court in which he argued, through case law and precedent, that none of the "errors" Cosby alleged were actually errors. In an earlier opinion, he wrote that he allowed the five other accusers to testify because their accounts had "chilling similarities" that pointed to a "signature" crime.  Prior-bad-acts witnesses could be increasingly crucial in other sex-crime cases and in other states where they are allowed, as long as their probative value outweighs their prejudicial effect. Cosby's lawyers quote case law in arguing that such testimony was "extraordinarily prejudicial," to the point that it "predisposed" jurors to believe he was guilty, thus effectively stripping him of the presumption of innocence.  In the Commonwealth's appellate brief, prosecutors echoed O'Neill's argument that such testimony is permissible under Pennsylvania law when it demonstrates a "signature" crime. To the contrary, defendant's drug-facilitated sexual assault of Constand was the culmination of a decades-long pattern of behavior evidenced by his prior bad acts towards the five witnesses sufficiently 'distinctive and so nearly identical as to become the signature of the same perpetrator,' " the prosecutors wrote, quoting from case law on the issue.  Cosby's appeal also raises other issues about his trial, such as his argument that he should never have been prosecuted because of a binding agreement with a previous district attorney in 2005 that he would never be charged in the Constand case because of insufficient evidence. He argues that O'Neill should have recused himself from the Constand case because his supposed "political feud" with former district attorney Bruce Castor meant O'Neill was "biased" against Castor when he testified as a defense witness at a pretrial hearing. And Cosby also challenged O'Neill's decision to allow his testimony from a 2005 deposition to be introduced at the trials, in which Cosby acknowledged acquiring quaaludes in the 1970s to give to other women before sex. "But it's still genuinely shocking just how much he struggles to do the bare minimum of being a fucking person," the "Last Week Tonight" host said on Sunday.  Oliver shared a clip of Trump visiting a hospital in El Paso, Texas, where victims of one of last week's mass shootings were being treated, and bragged about his crowd size during his previous trip to the city.  "Just consider the thought process that happened there," Oliver said, then took viewers through that process:  "He visited a hospital filled with victims of a mass shooting and thought to himself, 'Remember that other time when I was the center of attention and it was better?' And then he thought, 'Do you think anyone else remembers that?' And then he thought, 'I should remind them, right?' Then he thought, 'Great idea.' Then he thought, 'Thank you.' Then he thought, 'Ivanka.' Then he thought, 'No time.' And then he said it, and he was happy with how it sounded." Oliver also celebrated the legal and financial struggles of the NRA. At one point, he recalled the vow of late screen legend Charlton Heston, who served as the organization's president from 1998-2003. Succession’s season 2 premiere makes the show’s twist Shakespearean - Polygon Posted: 12 Aug 2019 04:25 AM PDT Succession's season 2 premiere makes the show's twist Shakespearean - Polygon Succession, the HBO drama now entering its second season, has often been compared to some of the millennium's best shows: a darker Arrested Development, The Sopranos via the Murdochs, a corporate The Thick of It or Veep (showrunner Jesse Armstrong wrote for both), a more politically crafty Game of Thrones (by this site). Such comparisons to prestige TV are apt and flattering, albeit limited. Like those shows, Succession explores the precariousness of ill-gotten wealth, familial dysfunction hidden just below a gilded surface, and the black-hole magnetism of terrible, powerful men. But as season 2 kicks off, laying on dramatic tension so thick you could cut it with the dialogue's deadly sharp wit, Succession, more than anything else in Peak TV, resembles a Shakespearean tragedy. [Ed. note: This post contains spoilers for Succession through season 2, episode 1, "The Summer Palace."] Shakespeare is woven into the DNA of the show, informing many dramatic plot twists and witty lines of dialogue. References to the bard are peppered throughout, including a notable scene in the fifth episode of season 2 (the last episode HBO sent for review) in which a rival family empire begins dinner with a passage from Richard II instead of grace. Logan looms. Peter Kramer/HBO Brian Cox, who looms over the show as patriarch Logan Roy, has often cited Shakespeare's King Lear as a strong inspiration for his performance. (Cox has played Lear more than 150 times, according to his own estimation.) Logan has much in common with the aging monarch: He's an irascible bully whose most frequent targets are the adult children from whom he demands flattery and obedience. And his haphazard succession plans throw an already dysfunctional family into chaos. If Logan is Lear, his youngest son, Roman (Kieran Culkin), is his dirtbag Fool. One could easily imagine Twelfth Night's Feste with a smirk calling Duke Orsino a "beta cuck." Logan's only daughter, Siobhan (Sarah Snook), makes a valiant effort at, Cordelia-style, separating herself from her family's machinations, but veers into Lady Macbeth territory as she's pulled ever closer to her father's toxic orbit. But perhaps the most Shakespearean character in Succession is the one who falls the least neatly into its archetypes. Kendall Roy (Jeremy Strong), the heir apparent to the Waystar Royco throne, is the linchpin for most of the dramatic turns in the show's first season. At the start of the series, he's a mess of contradictions: a socially awkward, arrogant prick; dissatisfied in a job he's not quite qualified for; desperate both for his father's approval and to get out of his shadow. Through a series of accidents and screw-ups, by the start of the second season he's a waxy golem, visibly sapped of vigor. Succession revels in this kind of dramatic irony, forcing its characters into impossible choices for which the audience already knows the inevitable, tragic outcome. We get the same gut punch when Kendall's Town Car hits traffic on the way to ousting his father as we do when the messenger fails to deliver Friar Lawrence's letter to Romeo. The writing is on the wall; all we can do is watch in horror. Kendall as puppet. Peter Kramer/HBO It's this commitment to grand Shakespearean tragedy that prevents Succession from falling too far into soapy melodrama, even when it threatens to do just that in the first season's climactic finale. As a refresher: Kendall, desperate to find some cocaine at his sister's wedding, takes a drive with a waiter that results in the young man's death, in an accident that mirrors Sen. Ted Kennedy's infamous Chappaquiddick incident. (Succession often borrows plot lines from history and current events — as did Shakespeare.) In the hands of a less confident showrunner, that moment would be played up for shock value. One could easily see the show's return heavy-handedly focusing on the cover-up, constantly reminding us that yes, that happened. Instead, the incident is barely mentioned in the season 2 premiere, save for one furtive conversation in a laundry room. Rather, it looms over Kendall's relationship with Logan, a sword of Damocles that grows sharper the longer it's ignored. Twisting allegiances, misfired shots, tragic misunderstandings, reversals of fortune, unspoken pacts, the playful mixing of comedy and drama and history — these are Shakespeare's core dramatic mechanisms, borrowed by Succession. By the start of the current season, Kendall is a shell of his former self. In the show's pilot, he bristled at the idea that he took orders from his dad; he now exists only to do Logan's bidding. Kendall even goes on TV to denounce the hostile takeover that he himself instigated.
