It still has both New York and California's attorneys general suing in opposition of the merger due to decreased competition, loss of jobs, and raising of service costs. In an interview with T-Mobile COO, Mike Sievert revealed the company's plans in case the merger is not approved. During an investor relations event today, Sievert spoke on the possibility of a settlement with the State Attorney Generals. "It's never off the table", he explained – despite his confidence that the merger would be approved. Final arguments for and against the mergers are expected to take place on January 15 with a decision expected next month. If the merger is blocked, T-Mobile would immediately begin a $9 million stock buy-back and purchasing more spectrum would be the first priority – this is according to T-Mobile CFO Braxton Carter. T-Mobile CTO, Nevile Ray admits the company has its sights set on 3.5GHz CBRS spectrum. T-Mobile has been working on the merger for over a year and a half by this point, and if T-Mobile challenges the Judge's decision, it could delay the merger talks even longer for a merger that the two carriers didn't expect to take this long. Amidst the news of T-Mobile's exit plans, Virgin Mobile is going to close its doors. The pre-paid carrier has confirmed to Gizmodo that it began contacting its customers this week to notify their transition to Sprint's other pre-paid network, Boost Mobile. Beginning on the week of February 2, we will be moving Virgin Mobile customer accounts to our sister brand Boost Mobile – consolidating the brands under one cohesive, efficient and effective prepaid team. – Virgin Mobile spokesperson As part of the merger, Sprint would need to sell assets to Dish Network, including Boost Mobile. In order to facilitate the move, Virgin Mobile's parent company, Virgin Group, has agreed with Sprint to transfer its customers to Boost Mobile (which also runs on Sprint's network) before the carrier is sold to Dish. Virgin Group is happy that it once again has control of the Virgin Mobile brand and hopes to "work on options to relaunch a modern mobile offer in the US." Her vacation was over, and she was heading back to Canada to her husband, Hassan Shadkhoo. Her flight was leaving from Tehran to the Ukrainian capital of Kiev. "I spoke to her ... 20 minutes before the plane took off," he said Wednesday in Toronto. She was worried about the tensions between Tehran and the United States after President Donald Trump ordered the killing of Iranian top general Qasem Soleimani. "She wanted me to assure her that there wasn't going to be a war. I told her not to worry. Nothing's gonna happen," her husband told CNN's news partner CBC. Then she said goodbye and turned her phone off in preparation for takeoff. The Kiev-bound Ukraine International Airlines flight never made it to its destination. It crashed after takeoff in Tehran on Wednesday, killing all 176 people aboard, including Sheyda Shadkhoo and 62 other Canadians. Hassan Shadkhoo said his wife had a premonition the plane was going down. Just before she left Iran, she posted a selfie on Instagram expressing her fears. US House to vote on preventing Trump from starting war with Iran - The Times of Israel Posted: 09 Jan 2020 12:06 AM PST WASHINGTON (AP) — Speaker Nancy Pelosi set a House vote for Thursday on limiting US President Donald Trump's ability to take military action against Iran as Democratic criticism of the US killing of a top Iranian general intensified. Pelosi, D-Calif., announced the plan in a one-page statement that said last week's drone strike that killed Gen. Qassem Soleimani was "provocative and disproportionate." The Democratic measure seems certain to pass over solid Republican opposition. A similar proposal by Sen. Tim Kaine, D-Va., faces an uphill fight in the GOP-run Senate. Because of a procedural dispute between the two parties, it was unclear whether Thursday's vote would be a step toward binding Trump's hands on Iran or a symbolic gesture of opposition by Democrats. Republicans say the proposal — a special type of resolution that does not get the president's signature — does not have the force of law. Democrats say that under the 1973 War Powers Act, it would be binding if also approved by the Senate. The matter has not been definitively decided by federal courts. The House vote on a war powers resolution was scheduled shortly after a briefing on Iran Wednesday by top administration officials that many Democrats criticized as lacking specific justification for the killing. Iran retaliated early Wednesday local time by launching missiles at two military bases in Iraq that house American troops. No casualties were reported. "Members of Congress have serious, urgent concerns about the Administration's decision to engage in hostilities against Iran and about its lack of strategy moving forward," Pelosi said in her statement. "Congress hereby directs the President to terminate the use of United States Armed Forces to engage in hostilities in or against Iran or any part of its government or military" unless Congress declares war on that country or enacts legislation authorizing use of force to prevent an attack on the U.S. and its forces, the five-page resolution says. The measure is being sponsored by freshman Rep. Elissa Slotkin, D-Mich., a former CIA intelligence analyst who had served in Iraq. The showdown between the White House and Capitol Hill was the latest example of Trump's willingness to break the norms in Washington. Trump did not consult with congressional leaders ahead of the attack that killed the Iranian general and afterward sent Congress a notification explaining the rationale, but kept it classified. Trump, facing one of the greatest tests of his presidency, said Wednesday that Iran appeared to be "standing down" and said the US response would be to put in place new economic sanctions "until Iran changes its behavior." The strikes by Iran had pushed Tehran and Washington perilously close to all-out conflict and put the world's attention on Trump as he weighed whether to respond with more military force. The Republican president delivered his remarks surrounded by his national security advisers in the foyer of the White House. His comments came after a late-night tweet in which he insisted "All is well!" after the strikes. Republicans have largely supported Trump's actions, saying the president was well within his power to take out Iran's architect of proxy operations against Americans in the Middle East. The US considered Soleimani a terrorist. "How much is enough? How many more Americans did Soleimani need to kill before somebody supports taking him out?" asked Louisiana Rep. Steve Scalise, the No. 2 Republican in the House. The world is a safer place without Soleimani in it, he added. Democrats were unconvinced that the threat posed by Soleimani was imminent or that other alternatives to the killing were pursued in good faith. By not disclosing many details of the threat, Trump was asking the American public to trust the very intelligence reports he has often disparaged, Democrats said. Some Republicans also criticized the briefing by Secretary of State Mike Pompeo and other top officials. Sen. Mike Lee of Utah said it was "probably the worst briefing I've seen, at least on a military issue," in the nine years he's served in the Senate. Lee called it "distressing" that officials suggested it would only embolden Iran if lawmakers debated the merits of further military action. Hugo native John Dolan shared a video of the incredible moment on Facebook last week, which shows the deer walking in a neighborhood street alongside his son. "My son was going to get mail and I noticed the deer coming close to him," Dolan wrote. "It's the coolest and craziest thing I have ever seen. A beautiful healthy doe, just cruising the neighborhood." In the video, Dolan tells his son to pet the wild animal. As he does so, the friendly deer moves in closer to him, almost commanding him to keep petting it. The deer then walks over to Dolan as he continues to record and he, too, begins to pet the animal. Suddenly, the deer walks onto their driveway and continues to walk around with them, taking in as much affection it can from its newfound human friends. "It's like a dog," Dolan's son said. Trump vs. Iran: It's not over - CNN Posted: 08 Jan 2020 11:06 PM PST While both sides can claim strategic advances and political payoffs, the riskiest standoff between the enemies in decades may have transitioned their confrontation to a new, more dangerous phase. That's because the structures of conflict and the diplomatic disconnect between revolutionary Iran and a nationalistic US administration that tore up the nuclear deal involving both countries are still in place. The showdown uncorked a fierce controversy in Washington, where there's a widening partisan dispute over Trump's rationale for the killing of Iranian Gen. Qasem Soleimani, which sparked the crisis. The weeklong scare also left a chilling memory of how the impulsive choices of a seat-of-the-pants President brought his nation to the cusp of another war in the Middle East. It's possible Trump might learn the wrong lessons from his brinkmanship. And the drama exposed the failings of a gutted national security team staffed largely by inexperienced or deeply ideological officials apparently prone to confusion and mixed messages. On the upside, tensions that culminated in Trump's evaluation that Iran was "standing down" after not killing any Americans in strikes at bases in Iraq did not spin out of control. Both sides were apparently able to telegraph their intentions, through public rhetoric and a Swiss diplomatic channel, to avoid miscalculations that could have spilled over into a war. While there are hopes that stepping back from the brink will give each side an incentive to kick off a fresh diplomatic process, it's more likely they will return to the same state of mutual loathing that has prevailed for 40 years. Iraq is still on edge -- a brace of rockets landed in the highly fortified Green Zone of Baghdad on Wednesday -- the area that hosts the US Embassy, which was previously attacked by a pro-Iran mob. The drones and missiles may have been pulled back for now, but it would be naive to assume this episode is over. Events in the Middle East take months and years to play out. And Iran's history suggests that it will not view a limited missile strike as sufficient vengeance for the killing of a top leader like Soleimani -- who headed the elite Quds Force of Iran's Islamic Revolutionary Guard Corps, meaning more proxy militia violence is likely. "I think that anybody who tells you that this is over and that the retaliation has now ceased and we can all make assessments based on where we are right now ... that's very unlikely. The story is far from over," said Susan Hennessey, a former National Security Agency attorney who is now a CNN legal analyst, on "The Situation Room." What Trump achievedStill, after looking like he was talking the United States into the kind of Middle East quagmire he decried as a candidate, Trump was glad to step back on Wednesday. "Iran appears to be standing down, which is a good thing for all parties concerned and a very good thing for the world," he said at the White House. The President's team, eyeing his reelection race, has material to work with. They will boast about how Trump, daring to take a step discounted by his predecessors as too inflammatory, wiped Soleimani, whom he blasted as a terrorist "monster," off the planet. More strategically, Trump may have established a principle that could be significant in future US-Iran tensions. The killing of Soleimani, who masterminded Iran's regional network of militia allies like Hezbollah and Hamas, signals that Washington now sees Iran's proxy activity as grounds for military action, a new threshold in the confrontation. "There was a direct attack, direct assault on the US Embassy, US sovereign soil, by Iranian proxies," said David Urban, a senior Trump political adviser and veteran of the first Gulf War. "This President, unlike presidents in the past, decided to say, 'No longer will the US allow Iran to attack the US via proxies,' " Urban told CNN's Christiane Amanpour. That new standard could be significant given Iran's record of using affiliated groups to attack US targets -- such as the assault on the US Marine barracks in Lebanon in 1983. But it could also be a trigger to a future conflict. Iran pockets its gainsIran also sent messages -- to Trump after taking the significant step of firing missiles from its own territory at US troops -- crossing its own new line in the clash with the President. It put its US-allied neighbors on notice that its missiles can hit targets like bases, airports and civilian cities -- and next time they may not be programmed to miss. And Tehran skillfully orchestrated Soleimani's funeral rites to foster an impression of unity, weeks after unleashing a brutal crackdown on anti-government protests amid economic blight brought on by Trump's devastating package of economic sanctions. Trump's threat to hit Iranian cultural targets, meanwhile, helped solidify the notion that Iran faces an existential threat from the US that the clerical government has for years used to cement its legitimacy. But the deeper trends revealed by these tense few days suggest that Iran and the US are not likely to just return to their respective corners and count their winnings. To begin with, the President's White House speech signaling that military action was over for now included a promise to tighten sanctions. While Trump said he was willing to "embrace peace with all who seek it," he showed no sign of relaxing conditions for dialogue with Iran that would effectively require the Islamic Republic to capitulate on its top issues. That means there is no way for Iran to loosen the straitjacket imposed by Trump's "maximum pressure campaign" other than proxy attacks on shipping, oil fields and in a possible more serious scenario, US targets in the region. How the showdown could erupt againThe US -- despite Trump's boasts that Americans are safer with Soleimani gone -- seems to have come out of the conflict in a worse geopolitical position. Iran has wriggled out of the last constraints of the Obama-era nuclear deal, raising fears of a possible race to an atomic weapon within months. The US now seems far closer to being forced out of Iraq after striking Soleimani on Iraqi soil, in an insult to Iraqi sovereignty. Trump compounded the damage by threatening to sanction the star-crossed nation invaded by US-led troops in 2003 if American forces are kicked out. Any US departure from Iraq would hamper the fight against extremism and hand a prize to Baghdad's bigger, more powerful neighbor. For reasons of military logistics, it would likely force the US to abandon the remnants of its fight against ISIS in Syria. In Washington, the step back from confrontation with Iran has taken some of the heat out of Trump's clash with Democrats in Congress over what at one point looked like another war. But Democratic lawmakers and some Republicans on Wednesday left classified briefings on the crisis by top officials disgusted by the presentation. Trump has claimed that he thwarted imminent terrorist attacks against Americans by killing Soleimani. GOP Sen. Mike Lee of Utah slammed "the worst briefing I've had on a military issue," as he and colleagues castigated the administration for dismissing their concerns about Trump's legal rationale for targeting Soleimani. Republican Sen. Rand Paul of Kentucky told CNN's Wolf Blitzer that he wasn't given overwhelming evidence that specific acts were about to happen. "There was no specific information given to us of a specific attack. I didn't learn anything in the hearing that I hadn't seen in a newspaper already," Paul said. The question of the timing of an Iranian attack is important because it bears on the legal justification for Trump's targeting of Soleimani. There was also fresh evidence of the disarray in Trump's national security team during a crisis that at one point saw conflicting signals sent over whether US troops were withdrawing from Iraq. Administration sources spoke on Wednesday of Iranian signals sent through Iraq and Swiss diplomats to the effect that the missile attacks were not meant to kill Americans. But Gen. Mark Milley, chairman of the Joint Chiefs of Staff, broke ranks. "I believe, based on what I saw and what I know, that they were intended to cause structural damage -- destroy vehicles and equipment and aircraft -- and to kill personnel. Put Your Plan On PaperThere's something very powerful about putting pen to paper and watching your plan unfold before your eyes. Writing out well-defined goals creates a foundation for achieving and repeating success. I have always believed that when you have clearly defined goals for the future and plans for reaching these goals, you will achieve more than those who don't plan. In fact, a recent survey mentioned in "What They Teach You at Harvard Business School: My Two Years Inside the Cauldron of Capitalism" found that college graduates who identified their career goals and wrote them down, earned ten times more than those who did not. What goals do you have? Write those goals down. Next, write down the steps you need to take to achieve the goal. If you have several goals, I recommend writing one or two down to keep the process from becoming overwhelming. China, US among Countries Offering to Help Indonesia Build New Capital - benarnews Posted: 08 Jan 2020 09:36 PM PST Indonesian officials are welcoming offers from China, Japan and the United States to help build the Southeast Asian nation's "smart and green" new national capital on Borneo island, a project expected to begin later this year. The involvement of foreign consultants, including those from the three countries, is needed to attract investors to the project, said Danis Hidayat Sumadilaga, director general of human settlements at the Ministry of Public Works. "There have been offers from Japan, China and the United States. We welcome all of them," Danis told BenarNews, adding that foreign involvement could "enrich the existing design so that it becomes more attractive." China is seeking a role in designing urban landscapes and water management, while the U.S. wants to help build infrastructure such as roads and bridges, Danis said. Meanwhile, Japan has expressed interest in building the future city's transportation and energy system. Danis said the Coordinating Ministry for Maritime and Investment Affairs was vetting the proposals from the three countries. While he did not name companies that would participate in the project, he said they had been involved in infrastructure projects in Indonesia and had good track records. Adam Boehler, the chief executive officer of U.S. Development Finance Corp. (DFC), is to visit Jakarta this week and could discuss investment opportunities in the infrastructure sector, according to an official at the American embassy who declined to be identified or release additional information. In a statement, the embassy said Boehler was scheduled to meet regional business leaders and senior government officials during his visit to Asia, which includes stops in Japan and Vietnam. The DFC is an independent government agency that provides financing for development projects. Officials at the Chinese and Japanese embassies could not immediately be reached for comment. In 2019, Indonesian President Joko "Jokowi" Widodo announced that the country would move its capital from traffic-choked and crowded Jakarta to a location on Borneo, citing lower risks of natural disasters such as earthquakes, tsunamis and volcanic eruptions as among considerations. Government officials hope to start moving the capital to an area in East Kalimantan province in 2024, the last year of Jokowi's second and final term in office. Basic infrastructure construction such as roads, dams and irrigation could begin in the second half of 2020, officials said. 'Looking for smart ideas' The new city is expected to cost 466 trillion rupiah ($33.5 billion) to build with part of the funding coming from public and private partnerships. Last month, the Public Workers Ministry announced three winners of a contest to design the new environmentally sustainable capital. "We are looking for smart ideas," said Suharso Monoarfa, the head of the National Development Planning Board (Bappenas). Bappenas gave the designers six months, starting this month, to prepare the masterplan with the help of foreign and local consultants picked by the government, Suharso told BenarNews. The Coordinating Minister for Maritime Affairs and Investment, Luhut Binsar Pandjaitan, said he had picked consultants from China and Japan to assist with the initial design work, national news agency Antara reported. He said experts from other countries might join the project later. Luhut said Japanese investment giant SoftBank Group had offered to invest $100 billion in the new capital and its chief executive Masayoshi Son was scheduled to visit Jakarta on Friday. "It's too good to be true, but it's ongoing and we are working on it. I told him that we are asking for only $25 billion and that's more than enough for the next five years," Luhut told Antara this week. In addition to the SoftBank pledge, the United Arab Emirates said it planned to contribute to an Indonesian sovereign wealth fund to finance infrastructure projects in the new capital, Jakarta's ambassador to UAE told Detik.com, an Indonesian news portal. Jakarta, with a population of 10 million people – or 30 million including its satellite cities – is grappling with frequent flooding and traffic congestion. As much as 36 percent of Indonesia's current capital could be underwater by 2050 mainly because of mass extraction of groundwater, according to a study by the Bandung Institute of Technology. Still, some environmental activists have criticized the planned move to Borneo, warning that building a new city in the middle of a forest could harm the environment, including endangered species such as orangutan. Reynhard Sinaga: Father of rapist says ‘punishment fits his crimes’ - BBC News Posted: 08 Jan 2020 09:06 PM PST The father of Reynhard Sinaga, the worst rapist in British legal history, has said his son's punishment "fits his crimes" after he was jailed for life. Sinaga, a 36-year-old PhD student from Indonesia, was found guilty of 159 sexual offences against 48 men. He picked up his victims outside clubs in Manchester and lured them to his flat, where he drugged and assaulted them while filming the attacks. On Monday, a judge jailed Sinaga for life, with a minimum term of 30 years. As Sinaga's family and friends come to terms with his fate, they have painted a picture of his life in Indonesia before he became a serial sexual predator. Speaking for the first time since his son was jailed, his father Saibun Sinaga told BBC Indonesian over the phone: "We accept the verdict. His punishment fits his crimes. I don't want to discuss the case any further." Sinaga's friends at the University of Indonesia say he was a flamboyant and popular student. "He was very social, friendly, easy to get along with and fun to work on projects with," one friend, who wished not to be named, said. She lost contact with him when he went abroad to continue his studies in the UK in 2007. Sinaga is said to have fallen in love with the city of Manchester and told his family that he wanted to live in Britain forever. Living close to Manchester's Gay Village, he was able to express his sexuality openly in a way that was impossible to do back in Indonesia. The oldest of four children, Sinaga was born in 1983 into a conservative Christian family, part of the Batak tribe from the island of Sumatra. His father is a wealthy businessman, who owns several branches of a private bank. It was his father's money that allowed Sinaga to be a perpetual fee-paying international student for more than 10 years, up until his arrest on 2 June 2017. Sinaga's father also financed his flat on Princess Street, in the heart of Manchester's city centre. His mother was the only member of the family to attend one of Sinaga's trials. She came to the first pre-trial hearing, but was not present for any of the four trials her son insisted on putting his victims through by pleading not guilty. She did, however, write a character witness statement, which was presented in his defence. "His family describe him as a good, very bright, religious boy who was a regular churchgoer," said Gulfan Afero, a consular official at the Indonesian embassy in London. When sentencing him to life in prison, Judge Suzanne Goddard QC noted the reference and said directly to Sinaga that his family "know nothing of your true nature". Police say they have evidence Sinaga targeted at least 190 victims in total. Further potential victims have come forward following his sentencing by contacting a dedicated helpline. Indonesia 'shamed'In Indonesia, news of Sinaga's crimes has elicited shock and anger. The story has gone viral, and on Monday, Sinaga became a trending topic when news of his sentencing broke. His family home has been swamped by the media. Many Indonesians took to social media to say Sinaga had brought shame on the country in the eyes of the world. Some called for him to face the death penalty (abolished in Britain in 1965). Others in Indonesia questioned his mental state on social media. But Mr Afero, who met Sinaga during the trial, said he was in a sound state of mind. "I met him three times in prison and he looked happy, healthy and calm," Mr Afero said. "He understands what he's facing and he showed no remorse because he insists he is not guilty. Therefore, he doesn't feel any burden." The judge dismissed Sinaga's defence that his victims had consented to sex with him, calling it "ludicrous" and "nonsense". Indonesians have also taken note of the processes in place in the UK to protect rape victims, such as psychological counselling and anonymity in media reports. "Take note of the way in England the victims are given counselling and trauma healing, while in Indonesia rape victims are always blamed and shamed!" wrote one person on social media. Another said: "See, here they are not saying the victims were wearing 'too-sexy clothes'." Fears of backlashFor Indonesia's LGBT community, Sinaga's case could not come at a worse time. While homosexuality is not illegal in Indonesia, in recent years there has been a wave of rising intolerance and hatred directed towards the community. On social media, some people have been accused of posting homophobic slurs in response to news articles about Sinaga's case. Gay rights activist Hartoyo told the BBC he feared the case "may be used by intolerant groups to push for criminalisation or further attacks on the gay community". "Even though it's clear that this is a criminal case that has nothing to do with the perpetrator's sexuality. This is about an evil person and I hope the local media makes that clear," he said. Like many people in Indonesia and Britain, Hartoyo said he was struggling to "understand why [Sinaga] did it", adding he was "deeply shocked and horrified by the crimes". Posted: 08 Jan 2020 07:36 PM PST JAKARTA - President Joko Widodo flew to the Natuna Islands on Wednesday (Jan 8) amid a stand-off between Indonesian warships and Chinese coast guard vessels and fishing boats in the rich fishing grounds between Malaysia and Borneo. His fourth visit to the regency of around 81,000 inhabitants, which is part of Riau Islands province, came just two days after the President asserted that Indonesia's territorial integrity was "non-negotiable". The Indonesian government had earlier summoned the Chinese ambassador in Jakarta to deliver a diplomatic note protesting against Chinese encroachment into Indonesia's exclusive economic zone (EEZ). This followed the discovery of two Chinese coast guard vessels, along with around 60 Chinese fishing boats, in Indonesia's EEZ near the Natuna Sea on Dec 19 and 24. Shortly after his arrival in the Natunas, Mr Joko, better known as Jokowi, visited the newly opened Selat Lampa Integrated Maritime and Fisheries Centre, which began operating last October. It is equipped with a dock and an integrated cold storage among other things. Addressing hundreds of fishermen, Mr Joko reiterated that Indonesia would not bargain on sovereignty over its territory, including the Natuna Islands. "I am coming here to ensure law enforcement pertaining to our sovereign rights over marine natural resources in the EEZ. The Navy and the Maritime Security Agency are here to guarantee that the laws are enforced," he was quoted as saying by the State Secretariat in a statement. The president also noted that although foreign vessels may enter the EEZ they could not exploit the resources in the area and any violations would be subject to Indonesian laws. Indonesia has stepped up efforts against intrusions of the Chinese fleet since last week. The military has deployed six warships, one maritime patrol aircraft and one surveillance aircraft to monitor the situation and the Maritime Security Agency has also deployed two patrol vessels for the same purpose in the Natunas. Despite the heightened Indonesian presence, however, two Chinese coast guard vessels and five fishing boats were observed remaining within the 320km EEZ in the Natunas this week. Over the past three years, Chinese naval vessels have repeatedly entered waters around the islands, with Beijing claiming part of the sea as its "traditional fishing grounds". In the previous instance of a major intrusion in 2016, the Indonesian president led a Cabinet meeting on a warship in the waters off the Natuna Islands. Jakarta has also renamed an area close to the contested South China Sea into North Natuna Sea - a move that largely irked Beijing. Indonesia is not a party to the dispute in the South China Sea where Beijing's claim to the vast waterway has encroached on those of Brunei, Malaysia, the Philippines, Taiwan and Vietnam. Separately, without referring to China and its claims over the South China Sea, Indonesia's Foreign Minister Retno Marsudi on Wednesday reiterated that her government rejected claims that were incompatible with and not recognised by international laws. What brought down the plane isn't yet certain, but some aviation safety experts and pilots called several aspects of the incident unusual. Because the crash occurred during heightened tensions between Iran and the U.S. information about the flight may remain scarce. All 176 people — 167 passengers and nine crew — on the Boeing 737-800 — were killed when it crashed two minutes after takeoff from Tehran. Video shared on social media showed what appeared to be the plane on fire, falling to the ground in a fireball outside of the Iranian capital. The plane was not the 737 Max model that was grounded in March last year after two fatal crashes, but it adds to attention on Boeing, which is scrambling to contain the fallout from those incidents. The crash occurred hours after Iran launched retaliatory missile strikes on U.S. positions in Iraq for the killing of Gen. Qasem Soleimani, timing that prompted speculation that a stray Iranian missile may have downed the passenger plane, but as of Wednesday evening, there was no evidence to support that. Airlines began avoiding airspace in the region, taking other routes due to the conflict. It can sometimes take investigators more than a year to determine the cause of a plane crash and getting information about the deadly incident has become more complicated. Iranian officials said they won't hand over a recovered black box from the crash site to the U.S. or to Boeing for review. Under international law, the country where the crash occurred controls the investigation. Boeing, the Federal Aviation Administration and the National Transportation Safety Board, because the plane was manufactured in the United States, would generally participate. "The United States will continue to follow this incident closely and stands prepared to offer Ukraine all possible assistance," Secretary of State Mike Pompeo said in a statement Wednesday. "The United States calls for complete cooperation with any investigation into the cause of the crash." Boeing offered its condolences to the victims and said it is "ready to assist in any way needed." If Iranian officials withhold data, "they're not going to be trusted in our eyes and whatever they say without giving us the data, we're not going to believe," said John Goglia, former member of the U.S. National Transportion Safety Board. "It would would be a very rare set of circumstances where an engine failure would cause a plane to crash," said Goglia, who has investigated accidents including the July 1996 crash of TWA Flight 800 that killed all 230 people on board. The engines were CFM56 models, one of the most commonly used engines in the world, made by a joint venture of General Electric and France's Safran. Pilots undergo simulator training for those scenarios and on commercial flights can usually find a safe place to land the plane, experts told CNBC, adding that engine failure breaking apart an entire plane is highly unlikely. The crew was highly experienced, including a captain who had 11,600 hours on Boeing 737 and 5,500 of those as a captain, according to the airline. "Given the crew's experience, error probability is minimal," Ukraine International Airlines vice president of operations, Ihor Sosnovsky, said in a statement. "We do not even consider such a chance." The Boeing 737-800 was in good condition and was serviced on Jan. 6, the airline said. It was delivered new to Ukraine International Airlines in 2016 and no problems had been recently reported, the company added. The flight took off from Tehran's Imam Khomeini Airport at 6:12 a.m. and lost contact at 6:14 a.m., according to flight-tracking site Flightradar24. The airline said the plane reached about 2,400 meters, about 7,900 feet, which pilots and experts said was a normal altitude for that stage in the flight. The abrupt cut to location data was peculiar, said Jeff Price, an aviation safety expert and a professor in the Department of aviation and aerospace science at Metropolitan State University of Denver, because when dealing with a mechanical failure, normally pilots would communicate with the airport and the plane would continue to transmit data. "It just went dark," Price said. "It's just odd." Some administration officials believe Iran intentionally missed areas with Americans - CNN Posted: 08 Jan 2020 07:06 AM PST Iran fired a number of missiles aimed at the bases in retaliation for the American strike that killed Iranian general Qasem Soleimani last week, further escalating tensions between the two countries. Officials have said there were no US casualties as a result of the attacks, though a full assessment is underway. The administration officials floated the notion that Iran could have directed their missiles to hit areas that are populated by Americans, but intentionally did not. And they suggested Iran may have chosen to send a message rather than take significant enough action to provoke a substantial US military response, a possible signal the administration was looking for rationale to calm the tensions. Iranian missiles also landed close to the US consulate in Erbil, but didn't target the consulate itself, though the belief is that they could have. "We could have done it and we didn't do it," is the message Iranians appeared to be sending, a State Department official said. This interpretation will be presented to Secretary of State Mike Pompeo during a briefing early Wednesday, and Pompeo is expected to brief President Donald Trump at some point later in the day. The President will address the nation about the incident at 11 a.m. ET, the White House said. The US gave Iran the "opportunity to do what they needed to do and not escalate by killing Americans," the official said, suggesting how the administration could frame the retaliation. This was "a smart move" by the Iranians who demonstrated that they had "more to lose" if they killed Americans. Now, the major question is if Iranian proxies follow suit, the official explained. Pompeo is "pragmatic" right now and the general sentiment Tuesday night was "let's take a breath." There were no additional moves taken overnight to add any more protection to US diplomatic facilities abroad. Iraq received "an official verbal message" from Iran about the missile attack shortly before midnight on Wednesday, according to a statement from Iraq's Prime Minister Adil Abdul Mahdi. He said Iraq was told that the strike would be "limited to the whereabouts of the US military in Iraq, without giving the exact location." Trump's decision to kill Soleimani, one of Iran's most powerful men, has touched off a fresh crisis between the US and Iran. Following the strike, Pompeo and other top officials had said US wants to de-escalate the crisis, but Trump on Saturday vowed specific military action against Iran if it "strikes any Americans, or American assets."
