Hong Kong leader refuses to give ground after poll setback - Virden Empire Advance Posted: 25 Nov 2019 09:08 PM PST Hong Kong's embattled leader Carrie Lam refused to offer any concessions to anti-government protesters despite a local election trouncing, saying Tuesday that she will instead accelerate dialogue and identify ways to address societal grievances. Lam said the central government in Beijing didn't blame her for the election outcome that gave the pro-democracy bloc a landslide victory with 90 per cent of seats and control of 17 out of 18 district councils. Trending StoriesNearly 3 million voters cast their ballot in a record turnout for an election that was viewed as a barometer of public support for more than five months of pro-democracy protests. The government's refusal to compromise despite the election outcome could spark fresh unrest at a time when the semi-autonomous Chinese territory has plunged into its first recession in a decade. Lam said Sunday's election may have reflected unhappiness with the government handling of the unrest but it also showed that many people want a stop to violence. "Let me just stress that after these five-six months, Hong Kong people have realized very clearly that Hong Kong could no longer tolerate this chaotic situation," Lam said at her weekly news conference. "Please help us to maintain the relative calm and peace that we have seen in the last week or so and provide a good basis for Hong Kong to move forward." In early September when she withdrew an extradition bill that sparked the protests, Lam said she had also given a detailed response to protesters' other demands including free elections for the city's leader and legislature, as well as a probe into accusations of police brutality. She said the government hopes to take advantage of the current lull in violence to accelerate public dialogue and set up an independent review committee to find solutions to deep-seated societal issues. "The next step to go forward is really, as you have put it, to engage the people. And we have started public dialogue with the community," Lam said. "But unfortunately, with the unstable environment and a chaotic situation, I could not do more on that sort of engagement. I hope that the environment will allow me to do it now." Some pro-establishment figures have pointed fingers at Lam for their loss, while the pro-democracy camp has asked her to step down. Protesters saw the extradition bill as an the erosion of their rights promised when the former British colony returned to Chinese control in 1997. The demonstrations have since expanded into a protest over what they see as Beijing's growing interference in the city. Some analysts said China's ruling party isn't likely to soften its stand on Hong Kong. Chinese media has muted reports on the poll outcome, focusing instead on how pro-Beijing candidates were harassed and the need to restore law and order. Beijing is treading cautiously partly to avoid jeopardizing trade talks with the United States. It also faces pressure from planned U.S. legislation that could derail Hong Kong's special trade status and sanction Hong Kong and China officials found to violate human rights. China's foreign ministry on Monday summoned U.S. Ambassador Terry Branstad for a second time to demand Washington block the bipartisan legislation on Hong Kong. Chinese Vice Minister Zheng Zeguang warned the U.S. would "bear all the consequences that arise" if the bill came into law. President Donald Trump has not committed to signing the bill and has 10 days from the time of passage last week to veto it. If he does not do so, it automatically becomes law while Congress could also override a veto with a two-thirds majority in both houses. In a boost to the city, Chinese e-commerce giant Alibaba listed on the Hong Kong stock exchange Tuesday, rising nearly 7 per cent in a strong before losing most of its gains later morning. SC ruling can change game - India Today Posted: 25 Nov 2019 08:33 PM PST The legal battle over the floor test for power in Maharashtra will come to an end on Tuesday as the special bench of the Supreme Court will pass its judgment on the plea by the Sena-NCP-Congress combine. After a special hearing on Sunday, the special bench of Justices - NV Ramana, Ashok Bhushan and Sanjiv Khanna - heard the detailed argument on Monday. Denying allegations of "bias and malafide" raised by the allied parties, the office of the Governor of Maharashtra told the court that his decision was based on the signed letter of support given by NCP leader Ajit Pawar. "The issue to be considered is whether the court can substitute the decision taken by the governor," argued Solicitor General (SG) Tushar Mehta, appearing for the Governor's office. Mehta informed the court that the letter sent by Devendra Fadnavis to Governor BS Koshyari on Friday (November 22) included a letter of support by the NCP legislative party leader, Ajit. The letter, as read out by Mehta, notes that Fadnavis, as leader of the BJP, had support of 105 BJP MLAs, 11 Independent and 54 NCP MLAs. "The Governor noted that Fadnavis has shown support of 170 MLAs. Governor in his wisdom invited the largest party to form the government. He does not have to go into a fishing inquiry. He could not have any other information, when leader of a party has given letter," said the SG. Attacking the allegations of the combine, Mehta also justified the decision of the Governor to not hold an immediate floor test. "The court is being told about possible horse-trading but in this case the Governor thought maybe the whole stable has been stolen" the SG argued, saying that while the Governor was aware that "there is some sort of welding going on outside", no communication was sent to him about the combine staking claim to government. When Justice Khanna pointed out that precedent cases show that orders were passed to hold floor test in 24 hours, the SG argued that such an order would be "constitutionally barred". "That's the Governor's decision. Can the court decide what agenda will be taken in the house? Constitutionally it is barred. Court can't monitor proceedings inside the house," argued the SG. Senior advocate Mukul Rohatgi, appearing for CM-elect Fadnavis on Monday, said that the Governor had "given 14 days to prove majority". Meanwhile, senior advocate Kapil Sibal, appearing for the Shiv Sena, told the court that the actions of the Governor and the Centre were "obviously malafide". AM Singhvi, representing the NCP, also told court that the signatures submitted by Ajit were "incorrect" as the party had not passed any resolution. "We have given a letter to the Governor yesterday saying that Ajit Pawar has been removed from post of CLP leader. The letter does not have a covering letter. I have signed affidavits from 48 MLAs saying we don't support Ajit Pawar," Singhvi told court. Sibal also called out the Prime Minister, Narendra Modi, and the Governor over the timing of withdrawing the President's rule, and the oath taking of Fadnavis and Ajit. Ex-White House counsel Don McGahn must appear before Congress for testimony, judge says - CNBC Posted: 25 Nov 2019 08:03 PM PST Former White House counsel Don McGahn must comply with a subpoena to testify before Congress, a federal judge ruled Monday in a decision that already faces an appeal by the Department of Justice. The case stemmed from an August lawsuit filed against McGahn by the House Judiciary Committee. The committee issued a subpoena to McGahn in April, seeking his testimony on matters related to former special counsel Robert Mueller's Russia probe. Trump administration lawyers responded that McGahn is "immune" from being compelled to testify. But U.S. District Court Judge Ketanji Brown Jackson disagreed. "It is clear to this Court," Jackson said of the ruling in Washington, D.C., federal court, "that, with respect to senior-level presidential aides, absolute immunity from compelled congressional process simply does not exist." McGahn's attorney, William Burck, told CNBC in a statement Monday evening that his client "will comply with Judge Jackson's decision unless it is stayed pending appeal." Minutes later, Justice Department spokeswoman Kerri Kupec confirmed to CNBC that the agency will appeal the ruling and seek to halt it from taking effect in the meantime. White House press secretary Stephanie Grisham claimed in a statement that Jackson's ruling "contradicts longstanding legal precedent established by administrations of both political parties." "We will appeal and are confident that the important constitutional principle advanced by the administration will be vindicated," Grisham said. Though the case predates the focus of the House impeachment inquiry into President Donald Trump, the ruling was expected to have implications on that investigation, as a test of Congress's powers to compel witness testimony from those who have worked in the executive branch. One such potential witness, former national security advisor John Bolton, has said that he will not testify unless a court orders him to do so. One of his deputies, Charles Kupperman, filed a lawsuit in October asking a different federal judge whether he must comply with a congressional subpoena to testify to impeachment investigators. Kupperman and Bolton share a lawyer, and the outcome of Kupperman's suit could determine whether Bolton testifies. House Democrats have sought to dismiss Kupperman's lawsuit, fearing delays could stymie the momentum of their investigation. In November, the leaders of the impeachment investigation withdrew the Kupperman subpoena and urged him instead to be "guided" by the outcome of the McGahn case. Though he has not testified, Bolton has emerged repeatedly in the recollections of other witnesses as a potentially instrumental witness for Democrats. The former National Security Council official Fiona Hill testified last week that Bolton was concerned by the actions of U.S. Ambassador Gordon Sondland, White House acting chief of staff Mick Mulvaney and others. Hill testified last week that Bolton told her to go to the lawyers for the National Security Council to tell them that he was "not part of whatever drug deal Sondland and Mulvaney were cooking up," Hill said. Bolton has signaled that he holds little sympathy for the White House. On Friday, he accused the administration of locking him out of his Twitter account, questioning whether the move was due to "fear of what I may say." Trump denied that he had Bolton's account locked. McGahn, the most prominent figure in Mueller's report, was supposed to testify before the committee about events examined by the former FBI director's investigation in May. A day before his testimony was scheduled to take place, White House Counsel Pat Cipollone wrote to Judiciary Committee Chairman Jerry Nadler, D-N.Y., saying that McGahn was "absolutely immune from compelled congressional testimony." The Judiciary Committee argued that such blanket immunity was not lawful and ran afoul of the Constitution's separation of powers. In court papers, the committee also argued that McGahn's testimony would be crucial to the committee's "decision whether to recommend articles of impeachment." Asia stocks trade higher; Alibaba makes blockbuster debut in Hong Kong - CNBC Posted: 25 Nov 2019 07:58 PM PST Stocks in Asia traded higher in Tuesday morning trade following record finishes overnight on Wall Street. Hong Kong-listed shares of Chinese tech behemoth Alibaba also popped on their debut, becoming the world's largest listing so far in 2019. Hong Kong's Hang Seng index gained 0.67% in early trade, with shares of Alibaba surging around 7%. Mainland Chinese shares also saw gains, with the Shanghai composite up more than 0.2% and Shenzhen component rising 0.68%. The Shenzhen composite added 0.513%. In Japan, the Nikkei 225 added 1.09% in morning trade while the Topix index gained 0.82%. South Korea's Kospi edged 0.69% higher. Meanwhile, shares in Australia gained in morning trade as the S&P/ASX 200 advanced about 1%. Shares of Westpac jumped more than 1.5% after the firm announced the resignation of its CEO and early retirement of its chairman. Shares of the lender have seen strong movements in recent days as the company is rocked by a money-laundering scandal. Overall, the MSCI Asia ex-Japan index traded 0.64% higher. In the U.S. overnight, the S&P 500 added 0.8% to close at 3,133.64 while the Nasdaq Composite gained 1.3% to end the trading day at 8,632.49. Both indexes also notched intraday records. The Dow Jones Industrial Average also saw a record close, gaining 190.85 points to 28,066.47. Monday's gains on Wall Street came after the market's rally paused last week, with the S&P 500 snapping a six-week winning streak. The Dow fell for the first week in five while the Nasdaq ended a seven-week run. Score at 162, alliance throws down the gauntlet to BJP - Deccan Herald Posted: 25 Nov 2019 07:18 PM PST The Shiv Sena-NCP-Congress combine staged a show of strength on Monday evening at a 5-star hotel in Mumbai, hours after they staked claim to form the government, and a day before the keenly awaited ruling of the Supreme Court on the political crisis. The event, a first in the state, was organised as an open challenge to Devendra Fadnavis and Ajit Pawar, who too claimed to have the numbers. Titled "Amhi 162" (We Are 162), it was witnessed by NCP supremo Sharad Pawar, Shiv Sena president Uddhav Thackeray and Congress' Mallikarjun Kharge and also included a pledge. "There would not be any problem in proving majority," Pawar said. "A government was formed in Maharashtra without a majority. The BJP didn't have a majority anywhere but formed governments in Karnataka, Goa and Manipur. But this is Maharashtra." Uddhav, who is likely to be the CM if Fadnavis falls, said that the alliance is not hungry for power. "We will stick to 'Satyamev Jayate'. We are followers of Chhatrapati Shivaji Maharaj," he said. Taking a dig at Fadnavis, he said: "I will not say 'I will come again'. 'We have already come'," the Sena president said. Senior Congressman Ashok Chavan thanked party president Sonia Gandhi, Rahul Gandhi and Priyanka Gandhi for allowing the Maharashtra unit to enter this alliance. On Sunday evening, the BJP tasked four veterans - Narayan Rane, Ganesh Naik, Babanrao Pachpute and Radhakrishna Vikhe-Patil - to garner the support of rival group MLAs. "Both sides discussed resolving core issues of common concern, reached consensus on how to resolve related problems (and) agreed to stay in contact over remaining issues for a phase one agreement," the Chinese-language statement said, according to a CNBC translation. Liu He, China's top negotiator on trade, spoke with U.S. Trade Representative Robert Lighthizer and Treasury Secretary Steven Mnuchin, the statement said. Also joining the call were Chinese Commerce Minister Zhong Shan, People's Bank of China Governor Yi Gang and Ning Jizhe, vice chairman of China's top economic planning body, the National Development and Reform Commission, according to the Commerce Ministry. Trade tensions between the world's two largest economies have persisted for more than a year, with both countries applying tariffs to billions of dollars' worth of goods from the other. Rather than address at once all the points of U.S. complaints — which range from bilateral trade to China's state-dominated economic structure — both sides are first trying to reach a so-called "phase one" agreement. China has said any such deal will require a rollback of tariffs, while the U.S. would like to ensure that Beijing will increase its purchases of American agricultural products. On Friday, Chinese President Xi Jinping told a U.S. business delegation visiting Beijing that China wants "to work for a phase one agreement on the basis of mutual respect and equality," according to an Associated Press report. Xi also said China holds a "positive attitude" toward the trade talks, the report said. "When necessary we will fight back but we have been working actively to try not to have a trade war." Arnd Wiegmann | Reuters Federal Reserve Chairman Jerome Powell signaled that interest rates are unlikely to rise anytime soon, saying Monday that the central bank remains firmly committed to meeting its inflation goals. The Fed considers a 2% inflation rate to be a signal of sustainable growth and a level that keeps interest rates high enough to allow for mobility in the event of an economic downturn. However, inflation has run well below that level for 2019 despite three interest rate cuts over the past four months. As part of a speech he delivered in Providence, Rhode Island, Powell expressed a sense of urgency in meeting the inflation part of the Fed's dual mandate. He said low inflation expectations feed on themselves and make it tougher for the Fed to support the economy. The chairman said in prepared remarks that "it is essential that we at the Fed use our tools to make sure that we do not permit an unhealthy downward drift in inflation expectations and inflation. We are strongly committed to symmetrically and sustainably achieving our 2 percent inflation objective so that in making long-term plans, households and businesses can reasonably expect 2 percent inflation over time." A symmetric goal means policymakers would be content with inflation running a little above or below the 2% level. Other Fed officials have said that a period of time above 2% would be fine, with some members suggesting the Fed make an express commitment not to raise rates until the goal is met. Higher rates are used to keep inflation low. Focus on the labor marketBroadly speaking, Powell repeated language he and other officials have used lately, saying he sees "the current stance of monetary policy as likely to remain appropriate" and "well positioned" so long as current "generally good" conditions persist. The Federal Open Market Committee at its October meeting cut its benchmark rate another quarter point to a range targeted at 1.5%-1.75%. "At this point in the long expansion, I see the glass as much more than half full. With the right policies, we can fill it further, building on the gains so far and spreading the benefits more broadly to all Americans," he said. In addition to the inflation commitment, Powell also elaborated on another issue that has gained more attention in recent days, namely the still-low labor force participation rate in the U.S. as well as the fairly muted wage gains. While the current labor force participation level is 63.3%, the highest in more than six years, Powell said it still is low compared to other countries and is another area of focus the Fed could use to ensure that the benefits of the decade-long recovery are spread more evenly. The pre-recession participation rate was above 66%. Powell said the Fed can help the participation and wage issues "by steadfastly pursuing our goals of maximum employment and price stability" though he said broader programs to support higher wages and a more engaged labor force are "beyond the scope of monetary policy" and more suited to legislators in Congress. MSCI's broadest index of Asia-Pacific shares outside Japan bounced 0.8%, after losing 0.4% last week. Japan's Nikkei firmed 0.9%, while Australian stocks rose 0.5% and Shanghai blue chips 0.4%. E-Mini futures for the S&P 500 added 0.3%, while EUROSTOXX 50 futures gained 0.6%. On Saturday, U.S. national security adviser Robert O'Brien said an initial trade agreement with China is still possible by the end of the year, though he warned Washington would not turn a blind eye to what happens in Hong Kong. Federal Reserve Chair Jerome Powell speaks later on Monday and is expected to underline the steady outlook for rates given the better economic figures. The euro was off at $1.1023 on Monday, having breached chart support at $1.1040, while the dollar edged up to 108.75 yen. Baramati hopeful of Sharad Pawar resolving NCP crisis - Deccan Herald Posted: 25 Nov 2019 05:43 PM PST Amid the political drama in Maharashtra with NCP's Ajit Pawar supporting the BJP to form the government, the people of Baramati, which is the bastion of Pawars, are hopeful that NCP chief Sharad Pawar will be able to resolve the current crisis in his party. Ajit Pawar, the NCP chief's nephew who won from Pune's Baramati seat in the last month's state polls with a huge victory margin of 1.65 lakh votes, on Sunday joined hands with the BJP in a coup and took oath as deputy of Maharashtra Chief Minister Devendra Fadnavis. While some locals from Baramati expressed displeasure over Ajit Pawar's step, others were hopeful that Sharad Pawar would be able to handle the situation and bring his nephew back into the NCP. "The decision of Ajit Pawar is wrong but we are sure that senior (Sharad) Pawar will bring him back to the party fold," a 35-year-old local from Baramati said on condition of anonymity. Another resident of Katewadi, a village in Baramati constituency, said recently, when it was almost decided that the NCP and Congress will form government with the Shiv Sena, some locals burst firecrackers. "But, there were no celebrations on Saturday morning when Ajit Pawar took the oath as deputy chief minister by joining hands with the BJP," he said. Hours after the dramatic political developments in Mumbai on Saturday, a huge hoarding in support of Sharad Pawar came up in Baramati, but it was removed by the local civic body within a couple of hours. Though police said the banner was removed as it was put up without permission in the municipal council premises, an NCP worker said the hoarding was removed to ensure that the "split" in the Pawar family does not come out in the open. When a local was asked whom would he choose between the two Pawars,he said, "We are in a state of confusion right now, but one thing is sure that everything will be good and Ajit dada will come back to the party fold." Goo posted the message in Korean, with a photo of herself lying in bed, to her more than 1.5 million followers. The post has since taken on a new meaning following her death as fans offered their condolences. "Rip (Rest in peace) going to miss u a lot. Like in ur last post good night and sweet dreams. May you be in a better place," one comment read. Goo's post has amassed more than 500,000 likes as of 9 a.m. on Monday. It is as yet unclear how the South Korean singer, who had just completed a mini-tour in Japan from Nov 14 to 19, died. Seoul police said they are still investigating her death after they found her motionless in her Seoul apartment at around 6 p.m. on Sunday. Goo was a former member of K-pop girl group Kara, which she joined in 2008. The group disbanded in 2016. Earlier in November, she released a solo Japanese-language single, Midnight Queen. In May, Goo was hospitalized after a failed suicide attempt, following a public row with a former boyfriend, hairdresser Choi Jong-bum, in which each accused the other of assault. Goo also said he threatened to release sex tapes of the two of them. At the time, the singer's manager found her unconscious in her apartment after he decided to check on her, as repeated phone calls to her went unanswered. Before that, Goo posted several Instagram posts that dwelt on issues of betrayal and self-doubt.
