The data added to growing fears the state was experiencing a second wave of the virus two weeks on from Black Lives Matter demonstrations in Melbourne. As of midnight, restrictions on household gatherings would be reduced to five guests, public gatherings - excluding restaurants and cafes - would be restricted to 10 and would remain in place until July 12 pending a review. The premier announced the planned opening up of pubs, restaurants and cafes to increase its number of patrons from 20 to 50 would be deferred to the July 12 date. The lifting of restrictions slated to recommence for the first time tomorrow night was permitted to continue including the reopening of gyms. "We have always followed the advice of our public health experts and that is what has helped us to avoid absolute disaster," Mr Andrews said. "Whilst today numbers and trends are challenging and problematic, we have avoided so many of those horror scenes around the world. | US attorney in New York says he's not resigning - DeKalb Daily Chronicle Posted: 19 Jun 2020 10:08 PM PDT WASHINGTON — The Justice Department said Friday the U.S. attorney who oversaw key prosecutions of President Donald Trump's allies and an investigation of his personal lawyer Rudy Giulani had left his job, but he insisted he had not resigned and his ongoing investigations would continue. Attorney General William Barr said in a statement that Geoffrey S. Berman was stepping down as the U.S. attorney for the Southern District of New York. The office is one of the nation's top districts, trying major mob cases and terror cases over the years. But Berman said in a statement later that he'd learned he was stepping down from "press reports." "I will step down when a presidentially appointed nominee is confirmed by the Senate. Until then, our investigations will move forward without delay or interruption," he said. Barr's announcement late Friday came after he visited New York City, and no reason was given for the abrupt departure. It was followed by a statement from the White House nominating the chairman of the Securities and Exchange Commission to the job, a lawyer with virtually no experience as a federal prosecutor. It comes days after allegations surfaced from former Trump national security adviser John Bolton that Trump sought to interfere in an Southern District investigation into the Turkish Halkbank in an effort to cut deals with Turkish President Recep Tayyip Erdoğan. "Doesn't sound like 'stepping down,'" Preet Bharara, the previous permanent U.S. attorney there, said in a tweet Friday. "Why does a president get rid of his own hand-picked US Attorney in SDNY on a Friday night, less than 5 months before the election?" Trump intends to nominate SEC Chairman Jay Clayton to the post, Barr said. The U.S. attorney in New Jersey, Craig Carpenito, will serve as the acting U.S. attorney in Manhattan beginning July 3, he said. Before taking the reins at the SEC, Clayton was a well-connected Wall Street lawyer who represented and advised a number of major companies, including Goldman Sachs, Barclays, Deutsche Bank and UBS. The office has prosecuted a number of Trump associates, including Trump's former personal lawyer and fixer Michael Cohen, who served a prison sentence for lying to Congress and campaign finance crimes, and has also been investigating Giuliani and his associates. He had recused himself from directly overseeing the Cohen investigation for reasons that were never disclosed. Berman has also overseen the prosecution of two Florida businessmen, Lev Parnas and Igor Fruman, who were associates of Giuliani and tied to the Ukraine impeachment investigation. The men were charged in October with federal campaign finance violations, including hiding the origin of a $325,000 donation to a group supporting Trump's reelection. Federal prosecutors in New York are investigating Giuliani's business dealings, including whether he failed to register as a foreign agent, according to people familiar with the probe. The people were not authorized to discuss the investigation publicly and spoke on the condition of anonymity. Bolton's tell-all, excerpts of which were posted by the news media this week, included details on how Trump sought to cut a deal to halt SDNY's investigation into whether Halkbank violated U.S. sanctions against Iran in order to free an American pastor imprisoned in Turkey. Six weeks after the pastor's release, Bolton writes that on a call with Erdoğan, "Trump then told Erdoğan he would take care of things, explaining that the Southern District prosecutors were not his people, but were Obama people, a problem that would be fixed when they were replaced by his people." The episode occurred months after Berman assumed the role of U.S. attorney. A Republican who contributed to the president's election campaign, Berman worked for the same law firm as Giuliani and was put in his job by the Trump administration. But as U.S. attorney, he won over some skeptics after he went after Trump allies. Berman was appointed by then-Attorney General Jeff Sessions in January 2018, months after Bharara was fired after refusing to resign along with dozens of other federal prosecutors appointed by President Barack Obama. Three months later, FBI agents raided Cohen's offices, an act the president decried as a politically motivated witch hunt. The following April, in the absence of a formal nomination by Trump, the judges in Manhattan federal court voted to appoint Berman to the position permanently. He has taken a direct hand in other investigations that have angered Trump. His office subpoenaed Trump's inaugural committee for a wide range of documents as part of an investigation into various potential crimes, including possible illegal contributions from foreigners to inaugural events. And weeks before the 2018 midterm election, Berman announced insider trading charges against an ardent Trump supporter, Republican Rep. Chris Collins. Collins, who represented western New York, has since resigned. Under Berman's tenure, his office also brought charges against Michael Avenatti, the combative lawyer who gained fame by representing porn actress Stormy Daniels in lawsuits involving Trump. The Ivory Coast international had a slow start to life in north London after arriving from Lille in a £72 million ($94m) deal last summer, but the early signs in 2020 were that he was starting to find his feet. He scored in the win against Manchester United and netted again as Newcastle were brushed aside 4-0 at the Emirates. Pepe also set up two other goals against the Magpies. Another assist followed against Everton as Arsenal's club-record signing began to show the sort of form that had Europe's top clubs circling last summer. But the shutdown stopped Pepe in his tracks. The momentum he was building came to a sudden halt and now the 25-year-old has to start all over again. To make matters worse, Pepe returned from lockdown with a slight injury issue which has left him behind most of his team-mates in terms of fitness. That meant he was an unused substitute in Arsenal's first Premier League back after the break, against Manchester City, but he will be hoping to feature against Brighton on Saturday as the Gunners look to bounce back from their disappointing defeat at the Etihad Stadium. For Pepe, it will be an opportunity to try and pick up where he left off in March and, for Mikel Arteta, it will be a chance to continue his bid to instil some consistency in a player who has shown flashes of brilliance in England but has yet to hit the heights of his final season in France. So, the quality is undoubtedly there and Arteta is optimistic about his chances of drawing the best out of Pepe delivering on a regular basis. "It's not easy to adapt to this league but Nico's putting in the effort and he's willing to do it," said Arteta. "It will come out. The Barcelona defender is not one to shy away from the truth. It was he who memorably confessed after a Supercopa de Espana hammering at the hands of Real Madrid in 2017 that he felt the Catalans were "inferior" to their bitter rivals for the first time in his Camp Nou career. So, it was no surprise to see him admit immediately after Friday night's dismal 0-0 draw at Sevilla that Quique Setien's side face an almighty battle with a resurgent Real to retain the Liga title. "It doesn't depend only on our results anymore," Pique lamented, alluding to the fact that while Barca top the table, Madrid are just three points behind with a game in hand. "It will be difficult to win this league. We will do everything we can. But from what I've seen in recent weeks, it would be a surprise if Real Madrid drop points." That kind of pessimism will upset Barca fans, of course. But then, the truth hurts sometimes. And there is no getting away from the fact that while many supporters thought previous coach Ernesto Valverde was the main problem at Camp Nou, Setien hardly looks like the solution. Indeed, it is worth remembering that after Pique spoke out in 2017, Barca went on to win La Liga; a repeat under Setien feels unlikely right now, given there has been no discernible improvement in their play since the former Betis boss took charge in January. Of course, Barca's problems extend far beyond the dugout. This a club blighted by boardroom incompetence, which has resulted in Lionel Messi, arguably the greatest player of all time, playing out the final stage of his career in a climate of chaos and uncertainty. This is a Barca side devoid of any real identity; a team of a few fine individuals but many fading stars and sub-standard signings because of the club's total lack of a coherent transfer strategy. Barca may have won their first two games after the break, against Mallorca and Leganes, but they were troubled at times by two relegation-threated adversaries. Sevilla were always going to provide a sterner test of the Blaugrana's title credentials – and they failed it. With Frenkie de Jong absent, they lacked dynamism and precision in midfield, while Luis Suarez unsurprisingly looked off the pace in his first start after a lengthy injury absence. That Antoine Griezmann began on the bench and only saw 15 minutes at the end of a game that Barca were desperate to win tells you everything about how the Frenchman's first season at Camp Nou is going. Messi, as he so often does now, dropped deeper and deeper in his desperation to provide a creative spark in the engine room – but to no avail. He has scored more times against Sevilla than any other side but, except for the odd free-kick, he never looked like registering his 700th career goal. In truth, this was not one of his better games and, basically, if he doesn't perform, neither do Barca anymore. All is not lost, of course. This was arguably the toughest fixture the Catalans had left in La Liga. And Pique is probably wrong: Real might well drop points between now and the end of the season. But he's definitely right about one thing: it's going to be difficult for this Barcelona side to win the title. But it appears the application has taken a blow, as an examining attorney ruled it was "indefinite and too broad", and the couple didn't pay enough money for the fees. The attorney's notes, seen by Yahoo UK, also reveal the application wasn't signed. The couple has six months to respond to the attorney's points or the application will be abandoned. | Bolton critique of Trump could define tell-all book battles - Houston Chronicle Posted: 19 Jun 2020 01:08 AM PDT  Now Playing: WASHINGTON (AP) — The White House fight with former national security adviser John Bolton is the latest chapter in a lengthy history of Washington book battles, yet it will likely define future cases between the U.S. government and former employees determined to write tell-alls. The government asked a federal court for a temporary restraining order to prevent the release of the book, claiming it contains classified material. But the book, set to be released Tuesday, is already sitting in warehouses. And media outlets, including The Associated Press, have obtained advance copies and published stories on the book. The 577-page book paints an unvarnished portrait of Trump and his administration. Bolton writes that Trump "pleaded" with China's Xi Jinping during a 2019 summit to help his reelection prospects and that political calculations drove Trump's foreign policy. Trump on Thursday called the book a "compilation of lies and made up stories" intended to make him look bad. He tweeted that Bolton was just trying to get even for being fired "like the sick puppy he is!" The two sides are set to face off Friday in U.S. District Court in Washington, adding Bolton's name to a long list of authors who have clashed with the government over publishing sensitive material. The government says Bolton violated a nondisclosure agreement in which he promised to submit any book he might write to the administration for a prepublication review to ensure government secrets aren't disclosed. After working for months with the White House to edit, rewrite or remove sensitive information, Bolton's lawyer says his client received a verbal clearance from classification expert Ellen Knight at the National Security Council. But he never got a formal clearance letter, and the Trump administration contends that the book, titled "The Room Where It Happened: A White House Memoir," still contains sensitive material. "The fact that the White House wanted multiple, sequential reviews is way out of the ordinary and it suggests the obvious point that there is a political motivation at work," said Steven Aftergood, a classification expert at the Federation of American Scientists. Ellis began his review of the Bolton book on May 2 at the behest of national security adviser Robert O'Brien. The lawsuit said Ellis has had "original classification authority" since 2017, allowing him to make decisions to classify material. A classification expert, who spoke on condition of anonymity for fear of retribution from the administration, disputed that. The expert said it is highly irregular for a political appointee like Ellis to be involved in the prepublication process. The expert said Ellis has never done a prepublication review of a book and only received his initial "original classification authority" training, which is required every year, during the first week of June, a month after he was asked to review Bolton's book. Turley and other legal experts wonder why the government waited until the last minute to go to court to stop the book's release. "It's a rather curious way to protect classified information if you allow thousands of these books to be held in barely secured warehouses around the country," he said. Classification battles have popped up regularly over the years. In 2010, the Defense Department negotiated to buy and destroy all 10,000 copies of the book "Operation Dark Heart," a story about the Afghan war by Anthony Shaffer, a former defense intelligence officer. It was initially cleared for publication by Army reviewers, but when spy agency reviewers took a look, they claimed it included classified information that could damage national security. Matt Bissonnette, who wrote "No Easy Day: The Firsthand Account of the Mission that Killed Osama bin Laden," was ordered to forfeit an estimated $6.8 million to the federal government in 2016 when he skipped a prepublication review by the Pentagon. The Defense Department claimed the book contained classified information. The publisher denied it did. In 2008, a former undercover CIA officer writing under the pen name Ishmael Jones published "The Human Factor: Inside the CIA's Dysfunctional Intelligence Culture," which recounted his work on weapons of mass destruction and terrorism. In 2011, a federal judge ruled that he had broken the law by not going through the CIA's prepublication review process, which Jones claimed the agency had stalled. A case that went all the way to the Supreme Court dealt with a book by Frank Snepp, who signed a nondisclosure agreement as part of working at the CIA and then published a book about the agency's activities in South Vietnam. He didn't get clearance from the CIA. A lower court denied Snepp royalties from the book, and the Supreme Court upheld that ruling in 1980. The Justice Department filed a similar action over former National Security Agency contractor Edward Snowden's book, seeking to collect all the proceeds because it didn't undergo a prepublication review. Under the law, the executive branch has the sole discretion to determine what material is classified. Aftergood, the classifications expert, said the Bolton case has turned the government's little-known prepublication review process into national news. "It's becoming clear that the whole policy needs to be reexamined and rewritten," Aftergood said. "As it stands, it's arbitrary and subject to abuse." Stephen Vladeck, a University of Texas School of Law professor who specializes in constitutional and national security law, said that while the court might be hesitant to prevent publication of the book, the Trump administration might "have a very good shot at preventing anyone from making any money off the book." Keith Urbahn, one of Bolton's literary agents and founding partner of Javelin, based in Alexandria, Virginia, said the book has sparked interest in the past two days from television and film representatives, but no deals have been signed.
